Can You Refuse Field Sobriety Tests? 0
This is a question I’m sure you and your buddies have out at the golf course all the time after a couple of drinks. It probably follows or is followed by the “can you pass the field sobriety tests” question. But it’s extremely important to know the answer to this question, particularly because field sobriety tests are for the most part junk science, and most cops are going to find that you failed them if you take them. Trust me on this, I’m a DUI attorney. I do this for a living.
Before I get too far, though, I want to point out that I am specifically a Seattle DUI attorney. This means I know Washington State laws very well. It also means I don’t know any other state’s laws very well at all. If you want this question answered with one hundred percent accuracy and you don’t live in Washington State, you probably should call someone up in your state and talk to them.
So, here we are, out on the road, the cop is glaring at you, or playing mister nice guy, and asks if you’d like to take some voluntary field sobriety tests. That’s right, he said voluntary. But he probably said it really quickly, and phrased his question like a statement, so you feel like you have to take them. But, in fact, they are voluntary. This means you have the right to say no.
And the best part about refusing to take field sobriety tests? It shouldn’t be able to be used against you in your case. I mean, the test is voluntary, right? That means you should be able to say no with no repercussions. That what voluntary means, you can do it or you can’t, and no one is supposed to care. But the cops will care. And they’ll probably try to guilt you into taking them.
So, next time you get pulled over and investigated for DUI in Seattle, ask for a DUI attorney as soon as you can, and then keep asking for one, and say no to field sobriety tests. It will be the best decision you ever made.
